Nearly 18 months after his homeowner’s association began levying fines for what it deemed an illegally erected flagpole, Canton resident Ron Tripodo has won the battle.
According to documents filed Aug. 24 in Cherokee County Superior Court, Judge Jackson Harris ruled in Tripodo’s favor, saying the BridgeMill Community Association didn’t have the right to require Tripodo to get approval for the flagpole.
The court ruled that the Freedom to Display the American Flag Act of 2005 gave Tripodo the right to fly his American flag on the 16-foot-tall, lit and landscaped flagpole he installed in his front yard.
Last year, the HOA began levying daily fines of $25 per day.
Harris denied Tripodo’s request for attorneys fees to be paid by the HOA.
Tripodo and his attorney could not be reached for comment by press time Aug. 30.
